Kai publishes frequently in both, international and national journals such as, for example, the European Journal of Risk Regulation, Europarecht, and the Zeitschrift für Europäisches Wirtschaftrecht. Addtionally, he has contributed to several edited volumes. His articles are frequently cited in highest court's decisions. He regularly acts as a reviewer on an ad hoc basis for several international peer-reviewed journals.
