Sharia and Halakha and the modernization of religious law

NEW OUC: The course offers an introduction to the historical background, development and doctrine of Islamic and Jewish law and their present-day application.

In the sharia seminar attention will be paid to the process of reception of Western law and limitation of the domain of Islamic law and to the recent projects of some Muslim countries to re-islamize their legal systems. Further, those fields of Islamic law will be dealt with that are nowadays still applied.

In the halakha seminar we will explore the impact of processes of modernization on Jewish (and Islamic) legal routine. How did emancipation and assimilation, individualism and the rise of psychology, secularization and globalisation affect the perception of the law? How did the modern public sphere, espcially the internet, change modern legal practice? Can religious law keep up with shifting ideas on gender, sexuality, personal integrity etc.? And how does traditional authority (sharia courts, rabbinical bate din) relate to modern citizenship?
