Profiel

Paul Ducheine (1965) is militair jurist. Hij is bijzonder hoogleraar Military Law of Cyber Operations & Cyber Security aan de Universiteit van Amsterdam.

Daarnaast is hij sinds 2015 Hoogleraar Cyber Warfare aan de Faculteit Militaire Wetenschappen van de Nederlandse Defensie Academie (juli 2012). Van 2008-2012 was hij UHD Militair Recht en van 2012-2014 UHD Cyber Operations aan die Faculteit.

Daarnaast is Ducheine (gast)docent Krijgsmacht & Staatsrecht en senior onderzoeker (Amsterdam Centre of International Law) aan de Universiteit van Amsterdam.

Ducheine is brigade-generaal bij de Militair Juridische Dienst van de Koninklijke Landmacht. Hij studeerde Weg- en waterbouwkunde aan de Koninklijke Militaire Academie (KMA) en vervulde tien jaar functies als officier der Genie.

Hij is afgestudeerd in Politicologie/Bestuurskunde (Vrije Universiteit Amsterdam) en Rechtsgeleerdheid (Utrecht). Hij promoveerde op het onderwerp Krijgsmacht, Geweldgebruik en Terreurbestrijding aan de Universiteit van Amsterdam.

Paul Ducheine is gespecialiseerd in Cyber Operaties en Militair (Operationele) Recht. Tot zijn domein behoren:

  • Cyber operations & Cyber security
    1. (militaire) cyber operaties, o.a.cyber warfare;
    1. juridische aspecten van (militaire) cyber operaties (incl. cyber warfare);
    2. de governance van cyber security (in NLD);

  • Krijgsmacht en interne of nationale veiligheid, Krijgsmacht en Staatsrecht;
    1. Koninklijke Marechaussee, militaire bijstand, bijzondere bijstandseenheden
  • Constitutionele aspecten van de krijgsmacht;
  • Geweldgebruik (in vredesoperaties).
  • Juridische aspecten van terreurbestrijding en acties tegen niet-statelijke actoren en terreurgroepen;
  • Rechtsregimes tijdens militaire operaties (humanitair oorlogsrecht, Ius in Bello, mensenrechten en   Rules of Engagement);
  • rechtsgrondslagen (rechtsbases) voor militaire operaties (Ius ad Bellum en nationale rechtsgrondslagen oa. Politiewet).

Ducheine is gastdocent International Humanitarian Law aan de UvA, de Rijksuniversiteit Groningen en de Universiteit Maastricht.

Samen met Eric Pouw verzorgt hij lezingen over Targeted Killing , Targeting en Targeting in Counterinsurgencies ( T.M.C. Asser Instituut, in cooperation with the International Centre for Counter-Terrorism, Summer School Programme 'Countering Terriorism in the Post 9/11 World).

Zijn onderzoek is ondergebracht in het Amsterdam Centre of International Law (ACIL), onder het programma Law of Armed Conflict and Peace Operations.

Hij is een van de (senior) onderzoekers in het Onderzoeksforum LACPO van de Nederlandse Defensie Academie, TMC Asser Institute, het Nederlandse Rode Kruis en ACIL.
