The American philosopher John Rawls’ ‘justice as fairness’ theory is based on the notion that people should be able to decide for themselves what they think constitutes a good life, i.e. a life worth living. Josse Klijnsma applies this theory to contract law – ‘contract law as fairness’. In doing so, Klijnsma specifically focuses on the position of small and medium-sized enterprises in European contract law.
