The judicial system in the Netherlands is under considerable pressure, and as a result criminal cases are often diverted from full criminal proceedings. Offences are decriminalised and handled in administrative procedures, for example, or diverted by way of an out-of-court settlement. Koen Vriend studies such avoidance mechanisms that either divert from or speed up proceedings, and uses the fair trial rights established by The European Court of human rights to provide a framework for assessing whether such proceedings are fair and legitimate.
