The settlement of personal injury and loss of dependency claims following an accident can be a long and arduous process. In 2010 the 'Subproceedings in Personal Injury and Loss of Dependency Claims Act' took effect. This Act introduced a new judicial procedure, referred to as ‘subproceedings’, which gives the parties the opportunity to submit an aspect of their dispute to the courts during their out-of-court negotiations. Monique Wesselink investigates the effect of subproceedings.
