Kelly Pitcher provides an in-depth examination of the judicial response at international criminal tribunals to procedural violations committed in the pre-trial phase of proceedings. She asks whether certain particularities of international crime proceedings warrant a different approach to addressing such violations than at the national level. She sets out the current law and practice of international criminal tribunals with regard to this matter, and then evaluates it using human rights and the relevant law and practice of two domestic jurisdictions as a framework.
