In 2009 the German Federal Constitutional Court judged that the European Parliament represents the populations of the individual member states and not the citizens of the European Union as a whole. Kathalijne Buitenweg argues that this judgement ignored crucial elements of the European Parliament’s nature, brushing aside important rules that determine how members of the European Parliament can carry out their representative mandate, and how they can present themselves to their electorate.
