Abuse of Market Power
Abstract:
The background for this presentation is the Discussion Paper by DG Competition on Article 82 (exclusionary abuses). We discuss, from an economic point of view, the Commission’s concept of dominance and the tests it proposes to separate competition on the merits from anticompetitive behavior. Incorporating arguments that we have made earlier in our discussion on the postal market, we argue that the Commission adopts a too broad definition of entry barriers. In our discussion of foreclosure, we will address the question to what extent experimental economics can inform the debate .
