Uit de krant en van de facultaire ondernemingsraad kwam het bericht bij de COR dat er opnieuw een ernstig geval is van seksuele intimidatie aan de UvA, nu bij opleiding Conservering en Restauratie van de Faculteit der Geesteswetenschappen. Ernstige zorgen rezen inzake de slachtoffers, de vrouwelijke studenten in dezen; welke aandacht kregen zij al die jaren? Verder is er verbijstering over de langdurigheid van bestaande klachten over de bron van het probleem: de docent.

Deze zaak is voor de COR een evidente reden om het bestaande beleid rond sociale veiligheid, die kennelijk niet voldoet, onder de loep te nemen. Er is daartoe meer informatie nodig. De COR verzoekt onder geheimhouding (art. 20 WOR) volledige opening van zaken in dit specifieke dossier om te kunnen bepalen welke procedures wel of niet werden gevolgd, waarom beslissingen zo werden genomen als ze werden genomen en welke verbeteringen nodig zijn.

De COR heeft van de wetgever een belangrijke stem gekregen in de totstandkoming van een geschikte beoordelingsregeling, van een geschikte klachtenregeling en van een geschikte klokkenluidersregeling. Afgaande op de eerste informatie over deze zaak, maar ook op grond van de vorige zaak die groot in de publiciteit is gekomen en andere zaken uit het verleden die minder publiciteit kregen en nu nog onbekende zaken, voldoen al deze regelingen niet om structureel onveilige situaties te voorkomen of naar behoren af te handelen.

Op grond van eigen analyse van de informatie rond deze zaak zal opnieuw worden gekeken naar wat voor de COR absolute voorwaarden zijn waaraan voldaan moet worden om in te stemmen met de reeds geplande herinrichting van het ‘huis van sociale veiligheid’.

De COR verwacht van het CvB of zij de probleemstelling, welke zij in een brief heeft ontvangen, deelt en wat de CvB-visie is op de verbetering van de sociale veiligheid. De COR zal nauwgezet alle actoren en hun verslagen beoordelen en van een stevig advies voorzien.

The Central Works Council (COR) is shocked by yet another extreme case of a lack of social safety at the UvA

The COR was informed by the newspaper and the faculty works council  about another serious case of sexual harassment at the UvA, this time in the Conservation and Restoration programme of the Faculty of Humanities. Serious concerns arose about the victims, the female students in this matter; what attention was given to their concerns? Furthermore, there is astonishment about the time-span of existing complaints about the source of the problem: the lecturer.

This case is an obvious reason for the COR to take a closer look at the existing policy on social safety, which apparently does not suffice. More information is needed for this purpose. The COR requests, with confidentiality (art. 20 Dutch Works Councils Act (WOR)), the full opening of files in this specific case in order to be able to determine which procedures were or were not followed, why decisions were taken as they were and what improvements are needed.

The COR has been given an important voice by the law in the establishment of a suitable assessment scheme, a suitable complaints scheme and a suitable whistleblower scheme. Based on the initial information about this case, but also based on the previous case that received a lot of publicity and other cases from the past that received less publicity and as yet unknown cases, the COR concludes that all of these regulations are not sufficient to prevent structurally unsafe situations or to deal with them properly.

On the basis of its own analysis of the information surrounding this case, the COR will re-examine the threshold conditions that must be met in order to agree to the already planned redesign of the ‘house of social safety’.

The COR expects the CvB to state whether it shares the problem definition, which it has received in a letter, and what the CvB's vision is for improving social safety. The COR will carefully assess all actors and their reports and provide a grounded advice.
